Use of This Site

Membership and Registration

You do not need to register or become a member in order to browse this site, view member ads and conduct searches. You must register to become a member in order to create your ad, called a personal profile page ("Personal Profile Page"). Two levels of membership are offered, unpaid and paid.

As a member, you may create your own Personal Profile Page, including your online headline, online text ad, newspaper headline and newspaper text ad, and you may uploaded photographs and answer profile and essay questions. Paid members may initiate email communication or voice message contact with other members. Unpaid members may not initiate email communication or voice messages, but may respond to emails and voicemails sent by a paid member. Paid membership can be for a certain length of time (one day, seven days, thirty days or ninety days) or it can be transaction-based (purchase of transactional "stamps.")

The registration process is available online by clicking on the appropriate links. During the registration process, you create your "username" and password and provide certain information, such as your first and last name, city of residence, zip code, email address, birth date and gender ("Profile Information"). Profile Information is further described in, and handled by Da Capo Publishing Inc. in accordance with, this site's Privacy Policy. To view the Privacy Policy, please click the Privacy Policy link in the bottom navigation bar at the bottom of this page. The only Profile Information that is available for viewing by users and other members of this site is your username, age in years, city of residence and gender.

Introductions

Users and members can browse Personal Profile Pages and conduct searches. Once a paid member sees another member's Personal Profile Page that is of interest, the paid member may initiate email contact via this site's private, internal email system, via the instructions provided on this site. That email message can be accessed and read by the recipient when on this site by going to "My Account" and following the appropriate links. As a member (whether paid or unpaid), you have access to a private area of this site where you may read and send email messages, listen to voice responses, edit your Personal Profile Page and perform other administrative functions.

Ownership of Site and Use of Content

You acknowledge that this website contain designs, information, communications, software, photos, text, video, graphics, music, sounds, images and other material and services (collectively "Content"), which is owned exclusively by Da Capo Publishing Inc. or its licensors. You agree and acknowledge that, notwithstanding that Da Capo Publishing permits access to the Content, the Content is protected by copyrights, trademarks, and other proprietary rights (including intellectual property rights), that these rights are valid and protected in all media now existing or later developed, and that your use of the Content shall be governed and constrained by applicable copyright, trademark and other intellectual property laws. In addition, Da Capo Publishing Inc. may terminate your membership (whether paid or unpaid) and this Agreement if your membership (whether paid or unpaid) has been inactive for a period of time, as determined by us. You understand that Da Capo Publishing Inc. may terminate this Agreement and your membership (whether paid or unpaid) without notice, if in Da Capo Publishing Inc.'s sole discretion you fail to comply with any term or provision of this Agreement. Upon termination, you must destroy all materials obtained from this website(s) and all copies thereof (except for any properly purchased items in your possession), whether made under this Agreement or otherwise. Termination will not affect any rights, obligations or liabilities that arose prior to such termination or that are pursuant to any other agreement between you and Da Capo Publishing Inc.

This Agreement shall be governed by and construed in accordance with the laws of the State of Vermont, without giving effect to any principles of conflicts of law. Venue and personal jurisdiction shall lie solely in the state and federal courts located in that State. If any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire Agreement between the parties relating to the subject matter herein and shall not be modified except as provided herein.
